Terms & Conditions

The general terms and conditions of sale are subject to the provisions of articles R211-3 to R211-11 of the Tourism Code relating to the “Contract for the sale of travel and holidays”, under Directive (EU) 2015/2302 transposed into the Tourism Code and which we reproduce in full below. These general conditions will be given to you with your contract. We have added to them because of the specific nature of our holidays. These are the “special conditions” of our agency, detailed below. Any purchase of a holiday implies acceptance of the general and special conditions of sale.

 

Special conditions

The present terms and conditions of sale govern the tourist services offered by Evazio, which are considered to be “packages” in the sense of the regulations, for which you benefit in particular from the rights set out in article 11 below. For trips for pre-constituted groups of travelers and/or trips organized by companies, new special contractual conditions may supplement and/or modify the present sales conditions. These new special conditions will be communicated with the offer for each of these types of trips. The person who registers in the name and on behalf of the various participants in a trip acknowledges having read the sales conditions and undertakes to pass them on to each traveler, together with all the information provided by Evazio.

1/ Registration

1.1/ Registration process

The registration process is as follows:

  • Select the tourism product(s) of your choice;
  • You can send us your request by e-mail or telephone, or fill in the information or booking form on the website.
  • On receipt of your request, we’ll e-mail you the registration form (or quotation, if applicable), which you’ll need to fill in carefully and return to us signed.

If the services of the chosen holiday are available, the registration is definitively binding on the customer, who may only cancel the contract under the conditions of article 2 below.
If the services of the holiday are not available, Evazio will inform the customer of alternative solutions. Acceptance by return e-mail is equivalent to registration. If the customer does not accept the proposed modifications, the registration will be cancelled and all sums paid by the
customer will be reimbursed in full.

1.2/ Terms of payment

All registrations are subject to the following fees:

  • A deposit of 30% of the total cost of the holiday. The remaining 70% must be paid no later than 30 days before departure.
  • Full payment of the total cost of the holiday, for bookings made less than 30 days before departure.

Failure to pay the balance may result in automatic cancellation of registration. In this case, no refund will be made.

2/ Modification and Cancellation

Any request by the customer to change travel dates will be considered as a cancellation by the customer, followed by a new registration, and will incur the cancellation fees set out below. Any request for a change of holiday service(s) after confirmation of the trip will be invoiced at €50 per file if the request is made 10 days or more before departure, and at €100 per file if the request is made 9 days or less before departure, provided that Evazio is able to satisfy the request. By way of derogation, the customer may request the following changes without incurring penalties:

  • Extending your stay
  • Increased number of participants

In this case, the customer will only have to pay the corresponding price supplement, without incurring any additional modification costs. 2.1/ Individual and group cancellations (6 people or more) Evazio must be notified in writing of any cancellations or modifications made by the customer prior to departure.
In the event of a cancellation on your part (unless you find a replacement), a cancellation fee will be charged:

  • More than 45 days before departure: non-refundable fee of €50 per person.
  • Between 45 and 31 days before departure: 30% of the price of the stay
  • Between 30 and 16 days before departure: 50% of the price of the stay
  • Between 15 and 8 days before departure: 75% of the price of the stay
  • 7 days or less before departure: 100% of stay

Special cancellation charges may apply to certain trips, in derogation of all or part of the above schedule. In this case, they will be described in the technical data sheets for these trips. These charges will be reimbursed to you (excluding insurance contribution and lump sum of €50 per person) by the “Cancellation” insurance in the event of justified cancellation, if you choose to take it out (see “Cancellation Insurance”). Any stay cut short by the customer will not be reimbursed. If the holiday is cancelled by us, either because the minimum number of participants has not been reached (decision taken 15 days before the date), or because of conditions jeopardizing the safety of the participants, or due to force majeure, in most cases you will be offered one or more alternative formulas or a full refund of the sums paid. No compensation can be claimed. Please note that any stay based on outdoor activities is subject to the vagaries of weather conditions. During a stay that has already begun, certain activities may be cancelled due to unfavorable weather conditions on the day they are scheduled to take place (decision taken by the activity provider only). In most cases, we will offer you a replacement activity. The customer agrees to accept these imponderables. In winter, lack of snow is not a condition for cancellation. In such cases, activities are switched to summer. You will be reimbursed in full for any services not taken and not replaced. No compensation can be claimed.

2.2/ Special clause for group cancellations (6 people or more)

In the event of cancellation on your part (unless you find a replacement), the fees for cancellation more than 45 days before departure are as follows:

  • In the event of cancellation of up to 25% of the total number of participants, Evazio will retain 50% of the deposit (minimum €50) for each participant cancelled.
  • In the event of cancellation of between 26% and 50% of the total number of participants, Evazio will retain 75% of the deposit for each participant cancelled.
  • In the event of cancellation of more than 51% of the number of participants at the time of booking, the full deposit will be retained by Evazio for each participant cancelled.

These costs will be reimbursed to you (excluding insurance contribution and a flat-rate charge of €50 per person) by the “Cancellation” insurance policy in the event of a justified cancellation, if you choose to take it out (see “Cancellation Insurance”).

2.3/ Cancellation by some participants and continuation of trip for others. Cost of shared services.

If one or more travelers on the same trip cancel(s) their participation in a trip maintained for the other participants, the following additional cancellation charges may be applied to the cancelling traveler(s):
For shared services maintained for the trip participants (e.g., shared room for several, transfer of persons or luggage): a charge equal to 100%, regardless of the cancellation date, will be billed to the cancelling participant(s) on their share of the trip’s shared services. These costs will be reimbursed to you (excluding insurance contribution and lump sum of €50 per person) by the “Cancellation” insurance in the event of justified cancellation, if you choose to take it out (see “Cancellation Insurance”).

3/ Insurance

3.1/ Assistance – Repatriation
3.1.1/ For residents of the European Union For your convenience, “Repatriation Assistance” insurance is included in the total price of your stay, with the exception of travel offers for groups or companies subject to prior quotation or contract, for which this insurance is optional. This insurance is underwritten on your behalf by the ASSUREVER group. Contract 4091226 – Option 19. It represents only 0.85% of the total cost of the trip (with a minimum of €3.90). This contract includes the following guarantees:

  • Transport / Repatriation: Actual costs
  • Sending a doctor on site: Actual costs
  • On-site immobilization: €46 / day (max. 10 days)
  • Extended stay: 46 € / day (max. 10 days)
  • Return of accompanying persons : Biller return
  • Medical expenses abroad (Deductible of €30 per case)

3.1.2. Pour les résidents Hors Union Européenne

Possibility of purchasing assistance: The cost is :

  • from 35 to 42 euros for 8 days max.
  • from 65 to 78 euros for 15 days max.

3.2/ Cancellation insurance (optional)

We have taken out “Cancellation” insurance with Groupe ASSUREVER. Contract 4091226 – Option 16. It represents 3% of the total amount of the trip (with a minimum of 6 €). This insurance covers the reimbursement of cancellation costs prior to departure (excluding administration costs of €50 per person) up to a maximum of €7623 per person and €38112 per event, (€15 deductible) for the following justified reasons:

  1. Death, serious bodily injury, serious illness, hospitalization of the customer or a family member defined in the contract, excluding relapses and aggravations.
  2. Serious material damage to home or business premises.
  3. Redundancy of customer or spouse
  4. Death, serious bodily injury, serious illness, hospitalization of the customer or a family member defined in the contract, including relapses and aggravations.
  5. Pregnancy status not known at the time the contract is taken out and against indicating the nature of the stay booked
  6. Medical pregnancy complications
  7. Hospitalization of more than 4 consecutive days due to mental illness
  8. Death, hospitalization >48 hours of uncles, aunts, nephews and nieces
  9. Contraindications and post-vaccination effects
  10. Getting a job, professional transfer
  11. Modification, deletion of paid leave
  12. Invitation to a make-up examination
  13. Administrative notices
  14. Refusal of tourist visa
  15. Theft from home or business premises
  16. Serious damage to the vehicle.
  17. Loss or theft of identity papers and/or travel documents
  18. Accident or incident involving public passenger transport, excluding strikes.

A copy of the General Terms and Conditions of Insurance will be given to you prior to registration on request.

3.3/ “Cancellation” insurance in the event of a strike by airline personnel. (Optional)

If you’d like to be insured in the event of a strike by airline staff, we can suggest you take out “Perle Confort” multi-risk insurance with Groupe ASSUREVER. The price is as follows Travel price per person Insurance price

3.4/ Bike rental / “Bike theft” insurance

If you rent a bike, it will be delivered to you in perfect working order and with the necessary equipment (pannier(s), lock, etc.). The bike and associated equipment must be returned in the same condition at the end of your stay. In the event of damage to the bike, the hirer undertakes to have the bike repaired by a professional at his or her own expense, or to pay Evazio the cost of repairing the bike within 15 days (on presentation of the invoice issued by the bike rental company). The hirer agrees to bear all costs arising from the loss or theft of the rented equipment. The bike is supplied with a lock (1 lock for 1 or 2 bikes). The bicycle frame must always be secured with the supplied lock to a fixed point firmly anchored to the ground (the lock cannot be removed from this fixed point without being opened). If your bike is stolen, you will be required to pay the following deposit:

  • 350 € for a standard touring bike
  • 1500 € for a racing or gravel bike
  • 2,000 for an electrically-assisted bicycle.

We offer “Bicycle theft” insurance, which exempts you from paying this deposit and must be taken out when booking your trip and/or rental bicycle.
This insurance costs :

  • 15 € for a standard touring bike
  • 30 € for a racing, gravel or electric bike.

4/ Administrative and health formalities

Certain administrative and/or health formalities required for the execution of the trip are available on the site. It is the traveler’s responsibility to find out about these formalities, to comply with them and, if necessary, to bear the costs. Before registering for your trip, you must check that you are in possession of a valid passport or other document that meets the requirements for transit through and/or entry into the country(ies) of travel. Please note that in some countries, passports must be valid for at least 6 months after the date of return. Non-EU nationals are advised to obtain information on administrative formalities (visas, etc.) and health requirements (vaccinations, etc.) from the relevant embassies and consulates before registering for their trip. The consequences of non-compliance with administrative and health formalities by the traveler, such as the impossibility of departing on the date indicated, are the sole responsibility of the latter. Evazio cannot, under any circumstances, be held responsible for the consequences of the traveler’s failure to comply with police, customs or health regulations prior to or during the trip (e.g. loss of identity papers and/or train tickets, etc.).

5/ Risks

Any hike or outdoor activity involves a risk, however slight. Each participant assumes these risks with full knowledge of the facts, and undertakes not to hold Evazio, the guides or the various service providers responsible for any accidents or incidents that may occur in the normal course of the activity. This also applies to beneficiaries and family members. Each participant must observe the rules of caution and follow the advice given by the guide. Evazio cannot be held responsible for accidents resulting from the carelessness of any member of the group. Some of our packages are sold without a guide. The package includes a description of the itinerary and/or a map of the area. Unaccompanied tours therefore require a reasonable knowledge of map reading and orientation, especially in the mountains. Evazio cannot be held responsible for accidents resulting from carelessness on the part of a participant, or from misreading or misinterpreting the descriptions.

6/ Modifications

For each trip, we indicate a program with the choice of itineraries, activities, accommodation and restaurants that we feel are best suited to the location and season. Our guides may modify some of them for reasons of weather, group size or safety. In addition, the programs have been drawn up according to the latest information available at the time of writing: imponderables are always possible, and situations beyond our control may alter the course of the program.

7/ Prices

All prices are given in euros, taxes included. What the price does and does not include is indicated in the data sheet for each trip or on the quote. The total price invoiced includes any additional services requested by the traveler. The total price of the trip, including any accepted supplements, is communicated to the traveler and mentioned on the invoice.

7.1/ Price changes

The price of our trips is firm, definitive and in euros. However, in accordance with article L211-12 of the French Tourism Code, the price may be adjusted upwards or downwards, up to 20 days before the departure date, without the possibility of cancellation/resolution on your part, for one or other (or both) of the following price evolutions:

  • passenger transport resulting from the cost of fuel or other energy sources;
  • the level of taxes or fees on travel services included in the contract, imposed by a third party not directly involved in the execution of the contract, including tourist taxes, landing taxes or embarkation and disembarkation taxes at ports and airports. Any refusal on the part of the traveller(s) to pay this adjustment, insofar as it is not significant, will be considered as a cancellation/rescission on the part of the traveller(s) and the cancellation charges in article 2 will be applied.

8/ Transport

Evazio is responsible for the proper execution of the transportation included in the package. Any delay in the customer’s arrival at the meeting point included in the package, for any reason whatsoever (technical incident, accident, cancellation, strike, additional stopover, fortuitous, political, social, cultural or climatic events), due to third parties or force majeure, shall not entitle the customer to cancel the trip free of charge, nor to any compensation, and Evazio shall not be liable for any consequences of any kind whatsoever, in particular the payment of pre- or post-transportation costs. 8.1/ Luggage transport In the event that the transport of luggage from one accommodation to another is included in your package, your luggage must imperatively be closed and deposited at the reception of your accommodation, provided with the labels which are supplied to you and which you must fill in according to our procedure (which is communicated to you before your departure). In the event of non-compliance with baggage tagging rules, the cost of searching for and transporting forgotten baggage will be billed to the traveler. The package includes 1 piece of luggage weighing 20kg per person + 1 small piece of hand luggage (handbag, school backpack) per person. Cabin suitcases are not considered as small hand luggage.
Any additional baggage may be charged up to €20 per bag for each transport. The traveler agrees to pay this supplement within 15 days.
We recommend that you keep your valuables (jewelry, precious objects, digital tools and computer equipment) with you and not leave them in your luggage during transport.
Evazio cannot be held responsible for theft or loss of luggage during transport.

9/ Complaints

9.1/ During the trip

We invite you to contact Evazio if you notice any non-conformity in the execution of the services of your trip, by dialing the emergency number or by contacting the local correspondent whose contact details will be given to you on the documents provided by Evazio.

9.2/ After your trip

Each traveler has the right to send a written complaint to Evazio as soon as possible following the date of return of the trip, accompanied by supporting documents. If the complaint has not been satisfactorily resolved within 60 days, the traveler may refer the matter to the Médiateur du Tourisme et du Voyage (Tourism and Travel Ombudsman), whose contact details are as follows: MTV Médiation Tourisme Voyage – BP 80 303 – 75 823 Paris Cedex 17. Full details of how to make a complaint are also available on the website: www.mtv.travel.

10/ Disputes

Except in cases of force majeure, and without prejudice to any legal recourse, all claims must be sent to Evazio 58 Rue Ferrère 33000 Bordeaux, by registered letter with acknowledgement of receipt, no later than 8 days after the date of return of the stay, accompanied by supporting documents. After this deadline, no claims will be accepted. Any dispute will be subject to the jurisdiction of Bordeaux.

11/ Modification of sales conditions

Evazio reserves the right to modify or update these conditions of sale at any time without notice. The version of the conditions of sale applicable to the booking of the trip is that in force on the day of booking.

12/ Traveller’s rights

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code. You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the Tourism Code. Evazio will be entirely responsible for the proper execution of the package as a whole. In addition, as required by law, Evazio has protection to refund your payments and, if transport is included in the package, to ensure your repatriation should it become insolvent.

General terms and conditions

Literal reproduction of articles R.211-3 to R.211-11 pursuant to Directive (EU) 2015/2302 transposed into the French Tourism Code

Article R211-3

All offers and sales of the services mentioned in article L. 211-1 must be accompanied by appropriate documents that comply with the rules set out in this section.

Article R211-3-1

The exchange of pre-contractual information or the provision of contractual conditions is carried out in writing. This may be done electronically. The name or company name and address of the organizer or retailer are mentioned, together with an indication of his registration in the register provided for in article L. 141-3 or, where applicable, the name, address and indication of the registration of the federation or union mentioned in the second paragraph of article R. 211-2.

Article R211-4

Prior to the conclusion of the contract, the organizer or retailer must provide the traveler with the following information: 1° The main characteristics of the travel services: a) The destination(s), itinerary and periods of stay, with the dates and, when accommodation is included, the number of overnight stays included; b) The means, characteristics and categories of transport, the places, dates and times of departure and return, the duration and place of stopovers and connections. When the exact time has not yet been fixed, the organizer or retailer informs the traveler of the approximate time of departure and return; c) The location, main characteristics and, if applicable, the tourist category of the accommodation under the rules of the country of destination; d) Meals provided; e) Visits, excursions or other services included in the total price agreed for the contract; f) Where this is not apparent from the context, whether any travel services will be provided to the traveler as part of a group, and if so, if possible, the approximate size of the group; g) Where the benefit of other tourist services provided to the traveller relies on effective verbal communication, the language in which these services will be provided; h) Information on whether the vacation trip or vacation stay is, in general, suitable for people with reduced mobility and, at the traveller’s request, precise information on the suitability of the vacation trip or vacation stay for the traveller’s needs; 2° The company name and geographical address of the organizer and retailer, as well as their telephone and, if applicable, electronic contact details; 3° The total price including taxes and, if applicable, all additional charges, fees or other costs, or, when these cannot be reasonably calculated prior to the conclusion of the contract, an indication of the type of additional costs that the traveler may still have to bear; 4° The terms of payment, including the amount or percentage of the price to be paid as a deposit and the timetable for payment of the balance, or the financial guarantees to be paid or provided by the traveler; 5° The minimum number of people required for the trip or stay and the deadline mentioned in III of article L. 211-14 preceding the start of the trip or stay for possible cancellation of the contract should this number not be reached; 6° General information concerning passport and visa requirements, including the approximate time needed to obtain visas, as well as information on health formalities in the destination country; 7° A statement indicating that the traveler may cancel the contract at any time before the start of the trip or stay, subject to payment of appropriate cancellation fees or, where applicable, standard cancellation fees charged by the organizer or retailer, in accordance with I of article L. 211-14; 8° Information on compulsory or optional insurance covering the cost of cancellation of the contract by the traveler, or on the cost of assistance, including repatriation, in the event of accident, illness or death.

With regard to the packages defined in e of 2° of A of II of article L. 211-2, the organizer or retailer and the professional to whom the data is transmitted ensure that each of them provides, before the traveler is bound by a contract, the information listed in this article insofar as it is relevant to the travel services they offer. The form by which the information listed in this article is brought to the attention of the traveler is set by joint order of the Minister for Tourism and the Minister for the Economy and Finance. This order specifies the minimum information to be brought to the traveler’s attention when the contract is concluded by telephone.

Article R211-5

The information mentioned in 1°, 3°, 4°, 5° and 7° of article R. 211-4 communicated to the traveler forms part of the contract and may only be modified under the conditions defined in article L. 211-9.

Article R211-6

In addition to the information defined in article R. 211-4, the contract must include the following information: 1° The particular requirements of the traveler that the organizer or retailer has accepted; 2° A statement indicating that the organizer and retailer are responsible for the proper execution of all travel services included in the contract, in accordance with article L. 211-16, and that they are obliged to provide assistance to the traveler if he is in difficulty, in accordance with article L. 211-17-1; 3° The name of the entity in charge of insolvency protection and its contact details, including its geographical address; 4° The name, address, telephone number, e-mail address and, where applicable, the fax number of the organizer’s or retailer’s local representative, a contact point or other service through which the traveler can rapidly contact the organizer or retailer and communicate with him effectively, request assistance if the traveler is in difficulty or complain about any non-conformity observed during the execution of the trip or stay; 5° A statement indicating that the traveler is required to communicate any non-conformity observed during the trip or stay in accordance with II of article L. 211-16; 6° Where minors, unaccompanied by a parent or other authorized person, are traveling on the basis of a contract including accommodation, information enabling direct contact to be established with the minor or the person responsible for the minor at the minor’s place of stay; 7° Information on available internal complaint handling procedures and out-of-court dispute settlement mechanisms and, where applicable, on the entity to which the professional belongs and on the online dispute settlement platform provided for by Regulation (EU) No. 524/2013 of the European Parliament and of the Council; 8° Information on the traveler’s right to assign the contract to another traveler in accordance with Article L. 211-11. With regard to the packages defined in e of 2° of A of II of article L. 211-2, the professional to whom the data is transmitted informs the organizer or retailer of the conclusion of the contract giving rise to the creation of a package. The professional provides him with the information necessary to enable him to fulfill his obligations as an organizer. As soon as the organizer or retailer is informed of the creation of a package, he provides the traveler, on a durable medium, with the information mentioned in 1° to 8°.

Article R211-7

The traveler may assign his contract to a transferee who meets the same conditions as he does for the trip or stay, as long as this contract has not produced any effect. Unless otherwise stipulated, the assignor must inform the organizer or retailer of his decision by any means capable of producing an acknowledgement of receipt no later than seven days before the start of the trip. Under no circumstances is this transfer subject to prior authorization by the organizer or retailer.

Article R211-8

When the contract provides for the express possibility of revising the price, within the limits set out in article L. 211-12, it must mention the precise methods used to calculate price variations, both upwards and downwards, in particular the amount of transport costs and related taxes, the currency or currencies which may have an impact on the price of the trip or stay, the portion of the price to which the variation applies, and the exchange rate of the currency or currencies used as a reference when establishing the price shown in the contract. In the event of a price reduction, the organizer or retailer has the right to deduct its actual administrative expenses from the refund due to the traveler. At the traveler’s request, the organizer or retailer shall provide proof of these administrative expenses.

Article R211-9

When, before the traveler’s departure, the organizer or retailer is obliged to make a change to one of the essential elements of the contract, if he is unable to meet the specific requirements mentioned in 1° of article R. 211-6, or in the event of a price increase of more than 8%, it informs the traveller as soon as possible, in a clear, comprehensible and visible manner, on a durable medium: 1° Of the proposed modifications and, if applicable, their repercussions on the price of the trip or stay; 2° Of the reasonable deadline within which the traveler must inform the organizer or retailer of the decision he has made; 3° Of the consequences of the traveler’s failure to reply within the deadline set; 4° If applicable, of the alternative service proposed, as well as its price. If the modifications to the contract or the alternative service result in a reduction in the quality or cost of the trip or stay, the traveler is entitled to an appropriate price reduction. If the contract is terminated and the traveler does not accept an alternative service, the organizer or retailer shall reimburse all payments made by or on behalf of the traveler as soon as possible and in any event no later than fourteen days after the contract is terminated, without prejudice to compensation pursuant to article L. 211-17.

Article R211-10

The organizer or retailer makes the refunds required under II and III of article L. 211-14 or, under I of article L. 211-14, reimburses all payments made by or on behalf of the traveler, less the appropriate cancellation costs. Such reimbursements to the traveler are made as soon as possible, and in any event no later than fourteen days after the cancellation of the contract. In the case provided for in III of article L. 211-14, the additional compensation that the traveler is likely to receive is at least equal to the penalty that he would have incurred if the cancellation had been his fault on that date.

Article R211-11

The assistance owed by the organizer or retailer in application of article L. 211-17-1 consists in particular of: 1° Providing useful information on health services, local authorities and consular assistance; 2° Helping the traveler to make long-distance communications and find other travel services. The organizer or retailer is entitled to charge a reasonable price for this assistance if the difficulty is caused intentionally by the traveler or by his negligence. The price charged shall in no case exceed the actual costs incurred by the organizer or retailer.
